The team provides, in harmony with the private client team, guidance to company directors for the implementation of effective commercial property holding strategies, which will be optimised not only legally but but also in terms of finance and tax.

The purpose of this type of service is to define:

  • the appropriate acquisition structure (on or off the balance sheet of the operating company, incorporation of partnerships, drafting of commercial leases, etc…),
  • the terms of acquisition (undivided interest, subdivision of title, building leases, financial leasing agreements, etc…)
  • and the terms of restructuring or of sale (in particular via the organisation of a data-room).

From a financial standpoint, we help our clients to analyse the relevance of acquisition or rental opportunities (real estate valuations, simulations etc…) and to define the best way to finance commercial property (amortizable, balloon, financial leasing, negotiation of bank securities, etc…).

Our assignment also consists of optimising estate taxation, in connection with the holding of commercial buildings, in particular in matters of income tax, corporate income tax, capital gains tax and, as the case may be, wealth tax.
